Construct Game Services Fair Use Policy

This Fair Use Policy ("Policy") governs the acceptable use of the Construct Game Services (the "Services") provided by Scirra Ltd ("we," "us," or "our"). This Policy is designed to ensure fair, reliable, and secure access to the Services for all customers while preventing misuse, abuse, and activities that may degrade performance or compromise security.

By using the Services, you agree to comply with this Policy in addition to any applicable Terms of Service, Service Level Agreements, and other contractual documents.

Purpose and Scope

The Services are built to support legitimate business and personal use at scale. This Policy defines reasonable usage limits and prohibited behaviors to:

  • Protect the availability, performance, and security of the Services
  • Prevent excessive or abusive consumption of shared resources
  • Ensure equitable access for all customers
  • Comply with legal, regulatory, and contractual obligations

This Policy applies to all customers, users, accounts, applications, workloads, and integrations that access or interact with the Services.

Acceptable Use

You may use the Services only for lawful purposes and in accordance with this Policy. Acceptable use includes:

  • Running applications, workloads, and services consistent with the intended functionality of the Services
  • Accessing resources within the limits of your subscribed plan or agreed-upon quotas
  • Implementing reasonable security practices to protect your account, credentials, and data
  • Using automation, APIs, and integrations in a manner that does not disrupt or degrade the Services

Prohibited and Unfair Use

The following activities are prohibited or considered unfair use:

Excessive or Abusive Consumption

  • Sustained usage that significantly exceeds typical patterns for your plan and negatively impacts other customers
  • Activities that intentionally bypass, manipulate, or ignore usage limits, quotas, throttling, or billing mechanisms
  • Load testing, stress testing, or benchmarking without prior written approval

Security and Integrity Violations

  • Attempting to probe, scan, or test the vulnerability of the Services or related infrastructure
  • Circumventing security controls, authentication mechanisms, or access restrictions

Network and Service Abuse

  • Generating excessive network traffic, API calls, or requests that disrupt service availability
  • Using the Services for denial-of-service attacks, traffic flooding, or similar activities

Unlawful or Harmful Activities

  • Using the Services to engage in illegal activities or to violate applicable laws or regulations
  • Hosting, transmitting, or distributing content that is unlawful, fraudulent, abusive, or infringes intellectual property rights
  • Using the Services to send spam, phishing messages, or other unsolicited communications

Usage Limits and Resource Management

We may implement reasonable limits on the use of computing resources, storage, bandwidth, API requests, or other system resources. These limits may include:

  • Rate limiting or throttling
  • Quotas or caps per account, project, or workload
  • Temporary restrictions during periods of high demand

Usage limits may vary by service, plan, region, or usage pattern and may change over time. We reserve the right to adjust limits to maintain system stability and fairness.

Maximum Players

Plans usually come with a max players limit. For unpaid plans if your player count exceeds this limit new player registrations will fail.

Paid plans, and plans that come free with Construct 3 subscriptions will allow you to exceed this threshold. When you exceed the threshold, you will be notified by email that you've exceeded your limit, and you will need to upgrade your plan within the next 5 days. If you do not upgrade your plan within this time frame, new registrations will start failing.

Monitoring and Enforcement

To ensure compliance with this Policy, we may monitor usage patterns, performance metrics, and system behavior. Monitoring is conducted in accordance with our Privacy Policy.

If we determine that your use violates this Policy, we may take one or more of the following actions:

  • Issue a warning or request corrective action
  • Throttle, limit, or suspend access to affected resources
  • Temporarily or permanently suspend or terminate your account
  • Pursue legal remedies where appropriate

We will make reasonable efforts to notify you before taking enforcement action, unless immediate action is required to protect the Services, other customers, or legal compliance.

Customer Responsibilities

You are responsible for:

  • Monitoring your own usage and ensuring it aligns with your plan and this Policy
  • Designing applications and workloads to use resources efficiently
  • Responding promptly to notices or inquiries regarding usage concerns
  • Ensuring that your users, employees, contractors, and automated systems comply with this Policy

Exceptions and Prior Approval

Certain use cases that exceed typical usage patterns may be permitted with prior written approval, such as:

  • Large-scale data processing or migration projects
  • Approved load testing or benchmarking
  • Specialized research or enterprise workloads

Policy Updates

We may update this Fair Use Policy from time to time. Changes will become effective upon posting or as otherwise communicated. Continued use of the Services after an update constitutes acceptance of the revised Policy.
